Argument Over FortNite Video Game Leads to Stepdad Fatally Shooting Stepson in Davenport

Davenport Police Chief to Address Media on Fatal Shooting Linked to Fortnite Dispute

The Davenport Police Department has scheduled a press conference today at 1:30 PM, where Chief Steve Parker will address the media regarding a tragic shooting that occurred Wednesday night, stemming from an argument over the video game Fortnite.

Initial Report

On Wednesday evening, May 21, at approximately 7:10pm, officers of the
Davenport Police Department responded to a residence on Citrus Landing Blvd in
Davenport regarding a domestic-related incident involving a step-father shooting and killing his step-son.

Shortly before 7pm, Kelly Agar Garcia (age 43) and his wife, Adriane Daza (age 48), were in their home on Citrus Landing Blvd with Adriane’s two (2) minor children (ages 9 and 11), as well as her adult son, Azareel J. Martinez (age26). Martinez and the minor children are the biological children of Adriane
Daza and the step-children of Kelly Garcia.

Adriane’s 9-year-old son was in Azareel’s upstairs bedroom playing the video
game, FortNite, which has previously been forbidden by the parents. Adriane
learned that the 9-year-old had been playing FortNite and decided to discipline him by taking away his cell phone. In doing so, this upset the 9-year-old. As he and Adriane were walking into Adriane’s bedroom, the
9-year-old proceeded to a nightstand where he removed a Smith & Wesson 9mm handgun from the nightstand drawer. Kelly and Adriane struggled with the 9-year-old over possession of the firearm, during which Kelly was able to gain possession of the firearm.

At that point, Azareel entered the bedroom and observed the 9-year-old in an agitated state and Kelly Garcia holding the firearm. A verbal altercation ensued between Azareel and Kelly, during which Kelly shot Azareel several times in the chest and abdominal area.

Azareel retreated from the bedroom with Kelly following him. Kelly shot Azareel twice more in the back before he ultimately collapsed.

Azareel was transported to a local hospital where he succumbed to his multiple
gunshot wounds.

As a result of the investigation, Kelly Agar Garcia has been charged with Second Degree Murder and Unlawful Storage of a Firearm (Accessible to Minor). He is currently being held in the Polk County Jail.

Forensic Investigators from the Polk County Sheriff’s Office assisted in this
investigation by processing the extensive homicide scene.
